Amados Amaros: a trajetória histórica, social e política de uma comunidade quilombola na garantia do direito a um território

Abstract

The Constitution is the primordial element of the organization of a State and everything around it. It sets the standards and the social relations of a people, aiming at the good of all. The Brazilian constitution brings in its text the Article 68 of the ADCT, which establishes the quilombola right to the land. Relying in this assurance, the quilombola group Family of the Amaros from Paracatu, MG, waits at the present time by the clearing of land demarcated by INCRA, as belonging to the group and mainly by definition of the impasse that was generated from the occupation of part these lands by Kinross mining. This case, treated with slowness and sluggishness, shows disrespect for the constitutional guarantee and the perpetuation of ignorance about the rights of those do not fit the liberal capitalist logic. Given this antagonism, we developed this study, in order to identify the actions of the State and its agents in its solution. This is a case study, developed through a qualitative research supported by interviews, visitations to families belonging to the group, bibliographic reading, analysis of document and interviews with representatives of governmental institutions and of the NGO Fala Negra. At the end of this study concluded that if, on the one hand there is a great development in the guarantee of the social rights by the Brazilian government, on the other hand, the strong presence of capitalist hegemonic field hinders the full realization of these advances.
