A função socioambiental da propriedade rural no Brasil: histórico e atualidades

Abstract

The present work aims to understand the socio-environmental function of rural property in Brazil, analyzing its importance, shape and current events, addressing the concepts of property, social function of property, social function of rural property and socio environmental function of rural property. The methodological procedures of the work were: bibliographic research and documentary research. The bibliographical research guided the conceptualizations and allocations of the themes within the research, the documentary research took place in the analysis of documents and legislative proposals. The approach followed critical paths, analyzing the property that was once an unlimited and perpetual right, until the advent of property with a social function and then, a socio-environmental function. The social function of the rural property arises from the imposition of restrictions of an environmental nature on the owner in the exercise of the right of ownership, the social and socio-environmental functions of the rural property keep considerable proximity, although they are different in some aspects. Property in Brazil has undergone transformations throughout the historical legislative process, the same has happened with the social function of property and later the socio-environmental function of rural property arises, several actors have contributed to the debate on the desecration of property in Brazil. Just as rural property is linked to the Brazilian agrarian structure, the same is true of the social and socio environmental function of rural property, from this fact several social problems arise, as is the case of land concentration and lack of effective agrarian reform policies. The results of the research indicate that the socio-environmental function of rural property is the scene of divergent and reactionary interests, with a strong legislative and governmental movement in order to relativize or suppress it.
